Terms of Use

Version 2.0 · Business customers · Last updated September 1st, 2026

These Terms govern business subscriptions to Industry Insider. If you subscribed before September 1st, 2026 as an individual member, your subscription remains governed by our previous terms, available at https://www.myindustryinsider.com/terms-of-use-individuals.

The short version

These Terms cover your account, your access and your billing. What you’re allowed to do with the data itself is covered by the Data Licence, which forms part of this agreement.

1. Who we are, and who these Terms apply to

1.1. Industry Insider (“we”, “us”, “our”) (ABN 39131551619). Our website is www.myindustryinsider.com (the “Website”).

1.2. Industry Insider is sold to businesses only — marketing agencies and ecommerce brands. By subscribing you confirm that:

  • you are entering into this agreement for business purposes, not personal, domestic or household use;

  • you are authorised to accept these Terms on behalf of the company named when you subscribe, and to bind it; and

  • the details you have given us are accurate.

1.3. In these Terms, “you” and “your” mean that company. “Your team” has the meaning given in the Data Licence — your employees and contractors while they are working for you.

1.4. How this agreement is made
You accept these Terms and the Data Licence by ticking the acceptance box at checkout and completing payment. We keep a record of which version you accepted and when.

1.5. The details we need from you
When you subscribe, you must give us:

  • your company’s full legal name and business address;

  • your ABN or, outside Australia, your equivalent business or tax registration number, if you have one;

  • a nominated point of contact — the person we share the Figma projects with under clause 4.1 and send notices to under clauses 7.2 and 20.1 — and their work email address;

  • a billing email address; and

  • the work email domain you want enabled for Portal access under clause 4.2.

We use your business address to work out how tax applies under clause 5.2, and your ABN or tax number to issue tax invoices. You must tell us promptly if any of these details change. Until you do, we may rely on the details we hold.

1.6. We may decline or end a subscription without cause
We may refuse an application, or terminate an existing subscription, at any time and at our sole discretion, without needing to give a reason. This includes, but is not limited to, applicants and customers who compete with us, who are owned by or affiliated with a competitor, or who we reasonably believe are acquiring access on a competitor’s behalf. If we terminate without cause, we will refund any subscription fees you have paid for the period after termination, calculated pro rata. The Initial Fee is not refundable in this situation, and the Data Licence continues to apply to data already delivered to you.

2. The Data Licence

2.1. Your use of the data is governed by the Industry Insider Data Licence (“Data Licence”), currently version 1.1, available at https://www.myindustryinsider.com/data-license. It forms part of this agreement and you accept it when you accept these Terms.

2.2. In summary, and without limiting what the Data Licence says: editable files stay inside your team; anything you create from the data — decks, reports, ads, posts, analyses — is yours to share and sell without limit; files that let someone explore the data themselves are capped; and you can’t sell the dataset itself or hand it over as a deliverable.

2.3. Order of precedence
If we sign a separate written agreement with you — for example, for a pilot or a negotiated arrangement — it prevails over both the Data Licence and these Terms to the extent of any conflict. Otherwise, the Data Licence prevails over these Terms on anything to do with the use, sharing, ownership or confidentiality of the data, and these Terms prevail on everything else — accounts, access, billing, the Website and the Portal.

3. What a subscription includes

3.1. Subject to payment and to these Terms, a subscription gives you:

  • Figma projects containing the website page and email records for the brands we track, in editable form, updated monthly; and

  • the Portal, our platform built on Sotion, containing the ads library and the AI assistant.

3.2. Initial Fee and included updates
Your first payment (the “Initial Fee”) covers the historical record delivered to you plus three months of updates from the date access is granted.

3.3. Monthly subscription
After those three months, access continues on a rolling monthly subscription. There is no minimum commitment beyond the initial three months, and you can cancel at any time under clause 6.

3.4. Scope of the dataset
The brands, categories, date ranges and asset types we cover are described on the Website at the time you subscribe. The composition of the dataset is fixed by design — you cannot nominate brands for us to add, and clause 7 sets out our right to change the set we track. If a specific brand or category matters to your decision to subscribe, ask us before you buy.

4. Access and accounts

4.1. Figma access
We share the Figma projects with the point of contact you nominate under clause 1.5, who may then share them within your team in accordance with the Data Licence. Tell us in writing if your point of contact changes, so we can move access across.

4.2. Portal access
Portal access is granted by email domain. Once we have enabled the domain you nominate under clause 1.5, anyone holding an email address at that domain can access the Portal. This means:

  • you must nominate a domain that your company controls and uses for work email. Free or shared consumer domains (for example gmail.com or outlook.com) cannot be enabled;

  • you are responsible for everything done under your domain, and for making sure everyone who can reach the Portal through it is part of your team as the Data Licence defines that term; and

  • if you want contractors on other email domains to have Portal access, ask us and we will enable individual addresses at our discretion.

4.3. Removing access is your responsibility
When someone leaves your team, it is your job to remove them from your Figma projects and to close or revoke their email address on your domain. We do not monitor your team’s composition and are not responsible for access that continues because it hasn’t been removed at your end. You remain responsible under rule 8 of the Data Licence for what a former team member does with access you have not removed.

4.4. No access outside your team
You must not give Portal access, Figma editing access, or credentials to anyone outside your team, and you must not work around our access controls, domain restrictions or the identifiers described in the Data Licence.

5. Fees, billing and price changes

5.1. All prices are in US dollars and are charged through our payment provider, Stripe. You authorise us to charge your nominated payment method for the Initial Fee and for each monthly renewal until you cancel.

5.2. How tax applies depends on the business address you give us under clause 1.5. For customers in Australia, prices include GST where GST applies. For customers elsewhere, prices are exclusive of any sales tax, VAT, withholding or other tax or duty imposed in your jurisdiction, which is your responsibility.

5.3. The monthly subscription renews automatically on the same day each month. To avoid the next charge, cancel before your next billing date.

5.4. Failed payments
If a payment fails, we may suspend your Portal access and pause your Figma updates until payment is made. Suspension doesn’t affect data already delivered to you, which you keep under rule 10 of the Data Licence.

5.5. Price changes
We may change our prices. A change won’t affect a period you have already paid for. We will give you at least 30 days’ notice before a new price applies to your renewals, and you can cancel under clause 6 if you don’t want to continue at the new price.

6. Cancellation and refunds

6.1. Cancelling
You can cancel at any time by emailing support@myindustryinsider.com or through the account management link on the Website. Cancellation takes effect at the end of the period you have paid for. Portal access and Figma updates stop at that point.

6.2. What you keep
Cancelling doesn’t take anything away from you. Under rule 10 of the Data Licence, data already delivered to you is yours to keep permanently, and the Data Licence keeps applying to it for as long as you hold it. [CHECK: confirm the mechanics — whether cancelled customers retain access to the shared Figma projects in a frozen state, or whether we hand over a final copy and remove them from the live projects that continue to receive updates.]

6.3. The Initial Fee is not refundable once we have given you access to the historical record, because that data is yours to keep regardless of whether you continue subscribing.

6.4. No refunds are given for unused portions of a subscription period, or for periods where you had access but chose not to use it.

6.5. Refunds we will consider
We will consider refunds in the case of technical errors on our side or unauthorised transactions. Requests must be made within 7 days of the charge.

6.6. Nothing in this clause limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded. Where the Australian Consumer Law applies and a guarantee cannot be excluded, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

7. Changes to the brands we track

7.1. We decide which brands we track, and how many
We may add, remove, replace, pause or archive brands, change the categories we cover, and increase or reduce the total number of brands tracked, at any time and at our sole discretion. We do this for reasons including the availability of source material, whether a brand remains feasible to collect, changes in a category, and our own commercial judgement.

7.2. Notice
Where a change is material — meaning we remove or stop updating brands you currently receive, or we reduce the total number of brands tracked — we will give you at least 30 days’ notice before it takes effect. We will send that notice by email to your nominated point of contact, which is sufficient notice for the purposes of these Terms. Adding brands, and swapping a brand for another in the same category without reducing the total, are not material changes and we may make them without notice.

7.3. If you’re not happy with the change, you can leave
If you no longer want the data we are collecting after a change, you may cancel your subscription. Cancellation takes effect at the end of the period you have already paid for, and no pro-rata refund is payable for that period. This right to cancel is your remedy for a change under this clause.

7.4. What you keep
A change under this clause has no effect on data already delivered to you. If we stop tracking a brand, you keep the entire history of that brand that we have already given you.

7.5. Continuing to pay after a notice under clause 7.2 means you accept the change.

8. Collection may pause or stop

8.1. Industry Insider is a living research product. We may, at our sole discretion, pause or stop adding new data to the Figma projects or the Portal.

8.2. If we stop updating altogether, we will tell you. Your access to everything previously delivered continues, and the Data Licence keeps applying to it. We will not automatically cancel your subscription or issue a refund — if you don’t want to keep paying for a product that is no longer being updated, cancel under clause 6.

9. Changes to the Services and to these Terms

9.1. We may modify, suspend or discontinue any part of the Website, the Portal or the services. Where a change materially reduces what you receive, we will give you at least 30 days’ notice, and clause 7.3 applies — you may cancel, effective at the end of your paid period.

9.2. We may update these Terms. We’ll post the updated version on the Website with a new “last updated” date and, for material changes, give you at least 30 days’ notice by email. Changes apply from the date stated in the notice. Continuing to use the services after that date means you accept them. Data already delivered to you stays governed by the Data Licence version you accepted when you received it, as rule 15 of the Data Licence provides.

10. The AI assistant

10.1. The AI assistant in the Portal is in beta. It is trained on part of our dataset rather than all of it, and its coverage of the record is incomplete.

10.2. Its answers may be inaccurate, incomplete or out of date. Verify anything the AI tells you against the underlying files before you rely on it, publish it, or pass it to a client. We don’t warrant the accuracy of its output, and it isn’t professional, marketing, legal or financial advice.

10.3. We may change, limit or withdraw the AI assistant. If doing so materially reduces what you receive, clause 9.1 applies.

10.4. Don’t enter your clients’ confidential information, personal information, or anything else you aren’t entitled to disclose, into the AI assistant.

11. Intellectual property

11.1. What we own and what we don’t is set out in rule 12 of the Data Licence. In short: we own the interpretation, tagging, structure, diagrams, analysis and the compilation and presentation of the dataset as a whole; we don’t own the underlying third-party material the dataset refers to — the advertisements, emails, website pages and creative assets produced by the brands we track — and we can’t grant you rights in it.

11.2. If you republish third-party creative that appears in our files, that is your responsibility, not ours.

11.3. The Website and the Portal, including their design, copy and structure, and the Industry Insider name and logo, are ours. Nothing in these Terms gives you a right to use our name or logo except to say truthfully that you are a customer.

12. Your conduct

12.1. You agree not to:

  • use the Website, the Portal or the data for any unlawful, fraudulent or abusive purpose;

  • attempt to gain unauthorised access to our systems, accounts or data;

  • scrape, crawl, bulk-download or use automated means to extract content from the Portal, beyond normal use of the features we provide;

  • reverse engineer the Portal, or circumvent any access control, domain restriction or identifier;

  • remove, obscure or defeat the identifiers described in rules 6 and 13 of the Data Licence; or

  • use the data to build, train or populate a competing dataset or competing product, as rule 7 of the Data Licence prohibits.

12.2. You are responsible for your team’s conduct. A breach by someone you have given access to is treated as your breach.

12.3. If these Terms or the Data Licence are breached, we may suspend or terminate your access. Where a breach is unintentional and can be put right, we’ll tell you what the problem is and give you a reasonable opportunity to fix it first, as rule 14 of the Data Licence provides. If we terminate for breach, you must stop using the data and delete the files we have supplied.

13. Confidentiality

The dataset and the source files are our confidential information, and rule 11 of the Data Licence sets out how you must treat them. This doesn’t apply to the outputs you create under rule 3 of the Data Licence, which you’re free to publish, or to information that becomes public through no fault of yours.

14. Third-party services

14.1. Industry Insider is delivered using third-party services, including Figma, Sotion, Chatbase, Stripe and Google Analytics, and the underlying material is collected from public sources including the Meta Ads Library. We don’t control these providers and we’re not responsible for their content, availability, terms or privacy practices.

14.2. You need your own Figma account to open and edit the Figma projects, and you are responsible for any fees Figma charges you. If a third-party provider changes or withdraws a service we depend on, we may need to change how we deliver ours; clause 9.1 applies.

15. No warranties

15.1. The Website, the Portal and the data are provided “as is” and “as available”. We don’t guarantee uninterrupted or error-free service.

15.2. The data is collected from publicly available sources and significantly transformed by us. We take care with it, but we don’t warrant that it is complete, accurate or free from error, and coverage varies between brands, categories and time periods.

15.3. The data shows what brands did, not what worked
A change a brand kept in place is worth investigating — it does not tell you what happened to that brand’s revenue, and we make no claim about the commercial outcome of anything the data records. You are responsible for the conclusions you draw and the decisions you and your clients make.

15.4. We don’t guarantee any particular business result from using Industry Insider — no pitch won, no client retained, no revenue gained.

16. Limitation of liability

16.1. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, goodwill, data or anticipated savings, arising from your use of the Website, the Portal or the data.

16.2. To the maximum extent permitted by law, our total liability for all claims in connection with this agreement is limited to the total fees you paid us in the 12 months before the claim arose.

16.3. Clauses 16.1 and 16.2 don’t limit any liability that cannot lawfully be limited, including under the Australian Consumer Law. Clause 6.6 applies where it does.

17. Indemnity

You indemnify us against any claim, loss or cost arising from your breach of these Terms or the Data Licence, from anything your team does with access you provided, or from your publication or use of third-party creative appearing in our files.

18. Privacy

Your use of the Website and the Portal is also governed by our Privacy Policy at [LINK], which sets out how we collect, use and protect personal information.

19. Governing law

This agreement is governed by the laws of Victoria, Australia. The courts of Victoria have non-exclusive jurisdiction, meaning either party may also bring proceedings in the courts where the other party is located.

20. General

20.1. Notices
We give notices under these Terms by email to your nominated point of contact and to your billing email address. You give notices to us at support@myindustryinsider.com. Keep your contact details current — a notice sent to an address you’ve stopped monitoring still counts as given.

20.2. Entire agreement
These Terms, the Data Licence and any separate written agreement we sign with you are the whole agreement between us, and replace any earlier discussions, proposals or marketing statements. Clause 2.3 sets out which prevails.

20.3. Assignment
We may assign or novate this agreement to a related entity or in connection with a sale of our business. You may not assign it without our written consent, which won’t be unreasonably withheld.

20.4. Survival
Clauses 11 to 17 and 19 survive termination, along with the Data Licence obligations that continue to apply to data you hold.

20.5. Severability and waiver
If any part of these Terms is unenforceable, the rest still applies. If we don’t enforce a right straight away, we don’t lose it.
